4. No Client Relationship Created by Website Use

Your use of this Site, including submitting a contact form or scheduling a Coaching Conversation, does not by itself create a coaching, consulting, advisory, fiduciary, or other client relationship with us. A service relationship is created only through a separate written agreement accepted by both parties.

5. Contact Forms and Scheduling

If you submit information through a contact form or use our scheduling tools, you agree that the information you provide will be accurate and complete to the best of your knowledge.

Submitting a form or scheduling a Coaching Conversation does not guarantee that we will offer services, respond within any particular timeframe, or enter into a business relationship with you.

6. Privacy

Your use of the Site is also subject to our Privacy Policy. Please review the Privacy Policy to understand how we collect, use, and handle information submitted through the Site.

7. Intellectual Property

All content on this Site, including text, graphics, logos, branding, design elements, downloads, audio, video, images, arrangements, and other materials, is owned by or licensed to Finley-RE Coaching and Consulting LLC and is protected by applicable intellectual property laws.

You may view the Site and print or download limited portions for your own personal, non-commercial use only, provided you do not remove any copyright, trademark, or other proprietary notices.

• copy, reproduce, republish, distribute, or publicly display Site content for commercial purposes;

• use our name, marks, brand elements, or content in a way that suggests endorsement, affiliation, or ownership; or

The Unshakable Mind and The Unshakable Executive are trademarks of Finley-RE Coaching and Consulting LLC. Other names, logos, slogans, or marks appearing on the Site may be our property or the property of their respective owners. No license or right to use any trademark is granted without prior written permission.

12. Limitation of Liability

To the fullest extent permitted by law, Finley-RE Coaching and Consulting LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the Site or its content.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Site or these Terms will not exceed one hundred U.S. dollars (US $100).

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Finley-RE Coaching and Consulting LLC and its owners, officers, employees, contractors, and representatives from and against claims, liabilities, damages, losses, and expenses arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Washington, and you consent to the jurisdiction and venue of those courts.

If you access the Site from outside the United States, you do so at your own initiative and are responsible for compliance with local laws to the extent they apply.

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Your continued use of the Site after updated Terms are posted constitutes your acceptance of the revised Terms to the extent permitted by law.

16. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect to the fullest extent permitted by law.

If you later enter into a separate written agreement with us for coaching or consulting services, that separate agreement will govern those services and will control in the event of a conflict with these Terms.
